– says Constitution is supreme to ParliamentGovernment has taken Speaker of the House, Raphael Trotman, and Opposition Leader, David Granger, to court over last week’s ruling that stopped Home Affairs Minister, Clement Rohee, from tabling any new Bills in the National AssemblyAttorney General Anil NandlallThe Constitutional motion was filed by Attorney General (AG),Cheap NFL Jerseys China Wholesale, Anil Nandlall and stemmed from last Thursday’s decision by Trotman, which also saw the Minister being ordered to appear before Parliament’s sanctioning body, the Committee of Privileges. The court action would again raise the issue whether the local courts have jurisdiction over Parliament. Government is arguing that the Constitution is what had established the Parliament of Guyana and therefore has authority. The motion to silence Minister Rohee was tabled by the Opposition Leader.Government, in what has been emerging to become a major stand-off in the National Assembly between the ruling party and the opposition over Rohee, had immediately objected to the ruling of the Speaker, and described it as political and illegal.President Donald Ramotar, over the weekend,Cheap NFL Jerseys China, had also blasted the Speaker.Trotman, in his ruling Thursday, insisted that the House has the authority to regulate the conduct of its members. The opposition, Alliance For Change (AFC) and A Partnership For National Unity (APNU) in July, passed a no-confidence motion against the Minister, citing his handling of the security portfolio.UnlawfulAccording to the court document filed by the AG and released to the media yesterday, government wants the Speaker’s ruling of sending the matter to the Committee of Privileges and of preventing Rohee from presenting any Bills,Cheap Jerseys Store, to be declared unlawful, unconstitutional, null and void, and of no effect.Speaker Raphael TrotmanThe action also wants the court to declare that the Privileges Committee has no jurisdiction to deal with or determine the issue. The AG asked for an order “setting aside, vacating, quashing or rescinding the decision and/or ruling” of Trotman. The government is also looking for an order that would set aside, quash or rescind “any decision and/or ruling of the Privileges Committee, arising from the decision” on the grounds that the referral is without any legal base. The court document also calls for an order directing the Speaker to permit Minister Rohee “to not only perform his functions as an elected member of the National Assembly, but also as an appointed Minister of the Government of Guyana…”In listing the grounds for filing the court action, the AG said that Granger tabled a motion which sought “that since the National Assembly, by National Assembly Resolution No. 18 of 2012, has expressed no confidence in the performance of the Honourable Clement Rohee, MP, as Minister of Home Affairs, that he be prevented from speaking in the National Assembly, so long as he is purporting to carry out the functions of Minister of Home Affairs as published in the Official Gazette.”Despite objections from the Government benches, the Speaker ruled that Granger’s motion was admissible and properly tabled.Pre-emptive ruling“The ruling of the second named Respondent is pre-emptive in so far as it has put into immediate effect the Motion proposed by the first named Respondent…”Nandlall also said that the ruling of the Speaker has pre-empted and will prejudice any findings of the Privileges Committee as it has the effect of sanctioning the Minister without due process being accorded to him.Opposition Leader David GrangerThe court documents noted that at no point in time was Minister Rohee offered an opportunity to speak during the debate on the motion to silence him.“A member of the National Assembly can only be committed to the Privileges Committee for a violation of a Privilege; that is,wholesale nfl jerseys, an offence committed within the precincts of the Parliament. Minister Clement James Rohee, MP has never been told which privilege he has violated or what offence he has committed.”Nandlall also contended that the ruling violates a number of constitutional provisions.Government also maintained that the National Assembly is subordinate to the Constitution.Constitution is Supreme“The National Assembly is a creature of the Constitution and whatever sovereignty it enjoys and functional autonomy with which it is imbued are subject and subordinate to the supremacy of the Constitution and consequently the doctrine of Parliamentary sovereignty does not apply.”The court document also said that the Joint Opposition in the National Assembly by virtue of their superior number cannot override, subvert,<a href="http://www.cheapwholesalejerse

By Kiana A. WilburgThe alarming number of civil and criminal cases that have been carried over from 2015 to this year has been highlighted in the latest Annual Report of the Supreme Court of Judicature.Minister of Legal Affairs and Attorney General, Basil WilliamsDuring 2015, a total of 6, 492 civil matters were filed in the Supreme Court Registry,Wholesale NFL Jerseys China, Georgetown; 1207 in the Sub-Registry, New Amsterdam; and 299 in the Sub-Registry Essequibo. This makes a total of 7,998 matters filed. To this must be added the backlog of 2,595 matters in Georgetown,Authentic Jerseys Cheap, 4,223 in Berbice, and 868 in Essequibo. This gives a total of 7,686 backlog matters. When this is added to the 7,998 filed in 2015 it gives a grand total of 15,684 matters which were to be heard in 2015.Kaieteur News understands that the Judges heard and determined 4831 matters in Georgetown, 595 matters in Berbice and 203 matters in Essequibo, making a total of 5,629 matters concluded in 2015. This would leave a total of 10, 055 civil matters pending at the end of 2015.The report also notes the concern of the officials of the Judicature regarding the number of civil cases awaiting trial. These cases continue to escalate. The officials said that the staff of the Supreme Court Registry continues its exercise of auditing all matters filed in the Registry by bundling them into categories of matters. These categories are abandoned, deserted,Cheap Jerseys Supply, ripe for hearing and pending in the Registry either for pleadings to be closed or for decisions to be delivered by Judges.Matters that are ripe for the hearing are sent to the chambers of the Chief Justice for assignment to judges for hearing. The abandoned matters are also assigned by the Chief Justice to Judges for call over of these cases so that Attorneys-at-law and litigants are given the opportunity to be heard. This is an ongoing exercise. In relation to this exercise last year, 158 Civil Matters were deemed abandoned. This follows the 829 that were completed in 2014, a further 265 in 2013 and 8,062 in 2012. The number of matters disposed of goes as far back as 2007 in Georgetown and 2005 in Berbice while Essequibo is dealing with current matters. The Supreme Court is also using the Alternative Dispute Resolution (ADR) method to deal with civil matters which is done on a voluntary basis. However, there are plans to make mediation a compulsory step in the civil procedure rules and also to expand the pool of trained mediators available to do mediation. At the end of last year, matters were referred to mediation by Judges of the High Court and through requests by Attorneys-at-Law/clients.As for Criminal cases, nhl jerseys outlet, it was noted that last year,Cheap Stitched Jerseys, 73 depositions were filed in the High Court Registry, Georgetown, 35 in the Sub-Registry, New Amsterdam and 16 in Suddie, Essequibo making a total of 124 depositions. To this number must be added the pending backlog of 213 in Georgetown, 179 in Berbice and 59 in Essequibo, making a grand total of 451 criminal matters to be heard.According to the annual report, 53 Criminal matters were completed in Georgetown, 16 in Berbice and 11 in Suddie Essequibo. The report said that these indictments reflect matters heard in Georgetown, Berbice and Essequibo for which Preliminary Inquiries (PI) were heard in the Magistrates’ Court.Officials of the Supreme Court noted, however, that the rising number of both civil and criminal cases that are to be heard by the limited number of Judges is disturbing. They said that civil matters,Cheap Jerseys From China Outlet, especially, most times involve dealing with complex issues which require hearing of evidence over a number in addition to dealing with authorities cited by Attorneys-at-Law.The officials said, “It is impossible for a Judge to complete 30 civil matters in one session more so, when Attorneys-at-Law are given adjournments too often. It is the hope of the administration that given time and space at the High Court, 20 judges will be able to deal with the backlog of cases positively.”Another problem they said that has to be addressed urgently is the number of cases completed but still awaiting delivery of judgment by judges. The officials said that in some cases, delivery of judgment is outstanding as far back as three years.

…as Phillip Bynoe endorses PPP/C at Linden RallyThe fact that another former prominent member of the People’s National Congress Reform (PNCR)APNU’s Presidential Candidate David Grangerhas now crossed over and is now in the camp of the People’s Progressive Party Civic (PPP/C) is not earth shattering and is not a cause for too much concern.A Partnership for National Unity’s (APNU) Presidential Candidate, David Granger,Cheap NFL Authentic Jerseys, was responding to the fact that the PPP/C at its most recent rally in Linden, unveiled prominent Lindener and former opposition senior functionary Phillip Bynoe in its camp.Granger dismissed the Bynoe endorsement of the PPP/C as not surprising and will not impact adversely on the APNU’s chances at the election come November 28.“He had left the party ranks a long time ago,” according to Granger. In December, 2008 President Bharrat Jagdeo, granted Bynoe a pardon from his treason charge for which he was on the run and a fugitive for several years. On the other hand,Wholesale NFL Jerseys, Mark Benschop languished for five years in prison on the same charge.According to the Government Information Agency, Bynoe had been writing to President Jagdeo since 2007 applying to him for a pardon. In his appeals, Bynoe reportedly expressed his remorse over the invasion of the Office of the President and the destruction of public property. In 2002, Bynoe campaigned throughout the country, urging citizens to protest against what he called atrocities against the people by the PPP/C Government. His campaigning helped to spark a massive march on July 3, 2002, which culminated in the storming of the Office of the President,Wholesale Jerseys China, leading to the shooting death of two persons and injuries to several others, as Presidential Guards opened fire on the intruders.Social activist Mark Benschop, who was a part of the march, was subsequently charged along with Bynoe for treason. He spent five years in prison,NFL Jerseys From China, until he too was pardoned by the Head of State. He had undergone a lengthy preliminary inquiry and trial in the High Court, where a single juror refused to agree with others on a not-guilty verdict.Immediately people concluded that political considerations caused that juror to stymie the not-guilty verdict.Granger said that the APNU is in no way fazed by the actions of Bynoe in his endorsement of the PPP/C.According to Granger, Bynoe’s action does not in any way affect the character of the PNCR. He did not have a constituency of voters that could have been cajoled away from the coalition.Bynoe has in the past been on the list of Candidates for the PNCR and has on numerous occasions outside of the 2002 incident rallied on behalf of that party.Speaking to the other defectors,Cheap NFL Jerseys Authentic, Granger said that they have made personal decisions and will have to answer to their former supporters why they made the decisions that they did.Singling out specifically the former President of the Guyana Trades Union Congress (GTUC) Gillian Burton, Granger says that she will have to explain to the workers for whose rights she had signed on to fight why she decided to endorse the PPP/C.Granger says that the PPP/C has been destroying the Trade Union Movement and for this too Burton will have to answer. While contending that the movement of Dr Richard van West Charles into the ranks of the Alliance for Change (AFC) will also not have a significant impact on the chances of the APNU at the election, Granger says that he too will have to answer for his action. As recent as May, Dr Van West Charles was still an active member of the PNCR and a member of the party’s General Council. Granger reminded too of a recent attempt to challenge for the leadership of that party and subsequently throwing heavy support behind the late Winston Murray and then Carl Greenidge.Granger says that while he is aware of small personal differences that Dr Van West Charles may have had with individuals within the party he was not aware of any differences he would have had with the party’s policies. The APNU’s Presidential Candidate says that Dr Van West Charles too will have to explain his position. All in all Granger insists that the movement of the likes of Joe Hamilton, Burton, Dr Van West Charles and Bynoe is no great loss to the PNCR and APNU in general.Granger says that what has been downplayed in recent times is the amount of support that the APNU has been able to garner. He spoke of persons from parties such as The United Force and others that have come out in full support of APNU.“There are more people coming than are leaving,” Granger said. The APNU Presidential Candidate also took the PPP/C to task for what he calle
