A businessman who police say shot at them while resisting arrest appeared in court yesterday to answer charges of fraud and the unlawful discharge of a firearm.Gopaul Tiwari,Wholesale Jerseys, a businessman of 89 Success Road,Jerseys NFL Cheap, East Coast Demerara, stood in the prisoners’ dock with an emotionless expression while Magistrate Judy Latchman read six charges to him.Police said that on May 9, last, at Diamond East Bank Demerara, he maliciously discharged a loaded firearm with intent, at a detective constable who was attempting to resist apprehension.He is also alleged to have shot at another detective constable by the name of Deonarine,Wholesale Jerseys, to prevent his lawful apprehension. He pleaded not guilty to both charges.He was also charged with three counts of fraud. He denied that at Eccles, East Coast Demerara he was solely entrusted $10.4M, in cash by Ghardarie Sewnarine to pay the money to the Deeds Registry at Georgetown but he fraudulently converted it for his own use and benefit.Additionally, he is alleged to have forged a transport to show that it was issued by the Deeds Registry knowing it was forged. He was also charged with conspiring with persons or persons unknown to defraud Ghardarie Sewnarine by forging a transport to show that it was issued by the Deeds Registry in Georgetown. The father of three also denied these charges.Attorney-at-law Bernard DaSilva told the court that his client owns a business known as ‘Speedies Enterprise” on the Success Public Road. The lawyer said that his client shoulders the responsibility of providing for his brother’s family “because his brother is a cancer patient”.The lawyer claimed that his client was driving at the time of the incident and no gun was found on him or in his car. He told the court that when police officers apprehended his client he was informed that they had dusted his client’s skin for gun powder residue and they had found none.As for the other charges of fraud he told the court that extensive investigation has to be done into the matter that may cause a lot of delay in time.The lawyer who said that he will not paint a false picture of his client told the court that Tiwarie was previously released on bail on a similar offence in a matter still pending before the court.Nevertheless,Isaiah Thomas Jersey, he made an application for his client to be granted bail and asked the court to consider his sick brother who solely depends on the defendant to take care of him and his family. He also asked the court to note that his client operates his business and if he is not granted his pre-trial liberty he may lose money.According to prosecutor Superintendent Vishnu Hunte,Bobby Doerr Jersey, a statement revealed that Tiwarie used a gun during the incident. However, Hunte told the court that advice is currently being sought on the matter.The prosecutor did not object to bail but asked that the defendant lodge his passport to the Criminal Investigations Department and that he report weekly to the fraud squad at the CID at Eve Leary as a special condition throughout the trial.
